Heat pump: permit or not? We have your city’s rules, wherever you are.

Following your city’s rules is entirely your responsibility.

Before the work, it’s up to you to check that the chosen spot meets your city’s or borough’s bylaw, your condo syndicate’s rules and your lease, and to get the permit if one is required. AirGreen installs the unit at the spot you choose and confirm.

If that spot doesn’t meet the rules, the consequences are yours: a notice from the city, a fine, a neighbour’s complaint, moving the unit. A move required after the fact is a new, billable service.

Six details that get a heat pump moved after the fact.

Taken from published rules, from Repentigny to Pointe-Claire. Miss just one, and the unit gets moved after installation.

Corner lot: Two streets, two front yards

Ahuntsic, LaSalle, Rosemont and Le Sud-Ouest send corner lots to the permit counter. Anjou allows the secondary front yard at 1.30 m, hidden by plants; Longueuil, the yard facing the street, at 1 m, hidden from the street.

Balcony: The balcony has its own rules

Longueuil: 4 dwellings or more, 4 storeys or fewer, 1 unit per dwelling. Saint-Bruno: 0.75 m high at most. Verdun: on the façade from 13 dwellings. Ville-Marie and Rosemont: never on the façade.

Roof: A roof unit in view is a problem

Longueuil and Repentigny: the unit must be hidden from the street. On the Plateau, a roof unit in view goes before the planning committee. In Verdun, a metal screen is required.

At night: The noise limit drops in the evening

Brossard: 50 dB from 9 p.m. to 7 a.m. Laval: 50 dBA from 9 p.m. to 7 a.m. Rosemont: 45 dBA from 11 p.m. to 7 a.m. Pointe-Calumet: 40 dB from 10 p.m. to 7 a.m., for any noise.

Wall unit or central: Different units, different rules

In Repentigny, a supplementary or wall-mounted unit can go in any yard, 1.2 m from the lot lines; a central heat pump on the side, at the rear or in the secondary front yard of a corner lot, 2 m away.

Replacing: Replacing isn’t installing

In Pierrefonds-Roxboro, replacing a unit in the same spot needs no permit. A new installation does. Côte Saint-Luc makes the same distinction.

The city permit is only one layer out of six.

A well-placed heat pump also respects the condo syndicate, the lease, the electrical rules, the refrigerant rules and the grant rules.

1. The city

Who decides: the city’s or borough’s urban planning department

Location, distance from lot lines, front yard, roof, noise, permit. This is the layer that changes most from one address to the next.

Who decides: the syndicate, sometimes the general meeting

The façade, roof and balconies are often common portions. Alteration work on common portions requires a three-quarters vote.

3. The landlord, if you rent

Who decides: your landlord

Neither the landlord nor the tenant can change the form of the dwelling. Get written consent before drilling through a wall.

4. Electrical work

Who decides: an electrical contractor (RBQ licence, subclass 16)

The connection is made by a licence 16 holder. When wiring is added, the contractor declares the work to the RBQ.

Only people with the required certificate may install, charge or drain a heat pump. Even if you install it yourself.

6. The grant

Who decides: Hydro-Québec (LogisVert)

You agree to comply with the laws and regulations that apply to the purchase and installation. The installer must hold the appropriate RBQ licences.

From the visit to the grant, in six steps.

Following the city’s, the syndicate’s and the lease’s rules, and getting the permit, are entirely the client’s responsibility (clause 8 of our terms).

1. Estimate visit (AirGreen). We look at the possible spots with you: yard, wall, balcony, roof.
2. Your city’s rules (You). You check your city’s or borough’s page and bylaw. If needed, call 311 or go to the counter. This check is up to you.
3. The approvals (You). Condo syndicate or landlord: written consent before the installation date.
4. The permit, if required (The city). Certificate of location, site plan, spec sheet. Processing times vary by city.
5. The installation (AirGreen). Licensed refrigeration technician and electrician. The unit is installed at the spot you chose and confirmed.
6. The grant (You). LogisVert application online, within 9 months of the installation.

Does your guide cover my city?

There’s a page for 234 municipalities: the island of Montréal (19 boroughs and 15 cities), Laval, the North Shore, the Longueuil agglomeration, 12 RCMs in Montérégie, from Vaudreuil-Soulanges to Pierre-De Saurel and Haut-Saint-Laurent, and 2 RCMs in Estrie: Brome-Missisquoi and La Haute-Yamaska. Do I need a permit to install a heat pump?

It depends on the city. Of the 234 municipalities in the guide, 63 require a permit or certificate, 50 don’t, and 10 depend on the case. In the other 111, the permits bylaw doesn’t name heat pumps or isn’t published online: ask urban planning. Laval, Longueuil (regular lot) and Brossard: no permit. Boucherville, Saint-Lambert and Saint-Bruno: permit. In Montréal, 8 of the 19 boroughs require one and 3 depend on the case.

Who is responsible if the spot doesn’t meet the bylaw?

The client. Checking the city’s, the condo syndicate’s and the lease’s rules, and getting the permit if one is required, is entirely the client’s responsibility (clause 8 of our terms). How much does a heat pump permit cost?

Published fees: free in Saint-Louis and Beauharnois; $20 in Sainte-Brigide-d’Iberville and East Farnham; $25 in Sainte-Clotilde, Pointe-des-Cascades and Waterloo; $30 in Lorraine; $32 in La Prairie; $39 in Pointe-Claire; $40 in Saint-Philippe and Verchères; $50 in Charlemagne, Saint-Basile-le-Grand, Saint-Louis-de-Gonzague and Saint-Stanislas-de-Kostka; $65 in Sainte-Anne-de-Bellevue; $70 in Pierrefonds-Roxboro; $80 in Saint-Paul-de-l’Île-aux-Noix; $121 in Outremont; $162 in Rosemont (fewer than 8 dwellings); $169 per unit in Saint-Léonard. Westmount: $60.69 review fee, plus a fee based on the value of the work. Based on the value of the work: Ville-Marie $9.80 per $1,000 (minimum $167.40), Montréal-Nord $11 per $1,000 (minimum $74), Mont-Royal $10 per $1,000 (minimum $300). Elsewhere, ask the city for its fee.

Can I put the heat pump in my front yard?

Rarely. 165 of the 234 municipalities don’t allow it in the front yard, including Blainville, Terrebonne, Saint-Lambert and most Montréal boroughs; several do accept the secondary front yard of a corner lot. Others allow it under conditions: Laval 3 m from the front lot line, 1.2 m high at most and hidden from the street; Longueuil if the unit is hidden from the street or a park; Boucherville 4.5 m from the front lot line behind an opaque screen; Repentigny for a supplementary or wall-mounted unit at 1.2 m.

How far from the lot line?

From 0.1 m (Saint-Constant) to 5 m (Saint-Valentin, Saint-Antoine-sur-Richelieu, Elgin, Howick, Bedford, Saint-Joachim-de-Shefford). The most common distances: 2 m (63 municipalities), 1.5 m (43), 1 m (30) and 3 m (30). Laval, Longueuil and Verdun require 1 m; Boucherville, 1 m on the sides and at the rear; Beaconsfield and Lachine, 2 m; Ville-Marie and Outremont, 3 m. A few cities, like Dorval and Terrebonne, set no distance but limit the yards allowed.

What noise level is allowed?

Cities that publish a figure usually measure it at the lot line. It ranges from 40 dB at night (Pointe-Calumet, Saint-Édouard) to 60 dB by day (Saint-Jean-sur-Richelieu, Saint-Bruno, McMasterville, Frelighsburg, Pointe-Calumet). By day, the lowest limit is 45 dB (Saint-Marc-sur-Richelieu, Napierville, Pointe-des-Cascades, Sainte-Marthe, Très-Saint-Rédempteur). Examples: 53 dB(A) in Longueuil, 50 dBA in Boucherville and Pointe-Claire, 55 dBA by day and 50 dBA at night in Côte Saint-Luc, 50 dB in LaSalle, Montréal-Nord and Saint-Léonard. Elsewhere, the noise bylaw and the good-neighbour rules apply.

What about a balcony?

Each city has its own rule. Longueuil accepts a unit behind the railing in a building of 4 storeys or fewer with at least 4 dwellings. Saint-Bruno: buildings with 4 or more dwellings, a unit of 0.4 × 1 × 0.75 m at most. Verdun: on the façade only from 13 dwellings. Ville-Marie accepts a balcony on the side or at the rear only; Rosemont, never on a balcony facing the front yard.

I live in a condo. Who has to approve?

The syndicate. The façade, roof and balconies are usually common portions. Rosemont–La Petite-Patrie even requires a letter from each co-owner or a resolution of the syndicate with the permit application.

I’m a tenant. Can I install one?

With the landlord’s written consent. The Civil Code forbids the tenant from changing the form of the dwelling, and the premises must be restored at the end of the lease.

Can my neighbour complain about the noise?

Yes. Beyond the normal annoyances between neighbours (Civil Code of Québec, art. 976) or the city’s limit, a complaint can lead to a notice. A good spot and a good distance prevent most complaints.

I’m replacing an old heat pump in the same spot. Do I need a permit?

Sometimes not: Pierrefonds-Roxboro and Côte Saint-Luc don’t require one to replace a heat pump in the same spot, and Saint-Michel doesn’t for a unit of the same kind. Elsewhere, check: the current rules apply to the new unit, especially if it is bigger or moved. Changing the type of heating system can also require a permit or certificate, for example in Côte Saint-Luc.

Who is allowed to install a heat pump in Québec?

Only a person who holds the required certificate may install, charge or drain the refrigerant (Regulation respecting halocarbons, ss. 43 and 44). The electrical connection requires a contractor with an RBQ licence, subclass 16.

Does the LogisVert grant require a permit?

The participation guide (v1.10) asks you to comply with all the laws and regulations that apply to the installation. If your city requires a permit, get it before the work.

Where can I read the official bylaw?

On your city’s website or at the permit counter. Each page in the guide cites its bylaw and sections. For Montréal, the page “Obtenir un permis pour installer une thermopompe” covers the 19 boroughs.
